The Municipality of Kincardine collects development charges to meet the increase in need for growth-related servicing arising from future development. These fees are adjusted annually.

Area-Specific Development Charges (ASDC) Background Study - Gary Street
This background study summarizes the findings of the Municipality of Kincardine’s Area-Specific Development Charges (ASDC) Background Study for Gary Street (formally the Ontario Peninsula Farm) lands. The development charges identified in this study update the Municipality’s existing area-specific development charges levied under DC By-law 2019-048.
Notice of Passing of Area-Specific Development Charges By-law by the Corporation of the Municipality of Kincardine
TAKE NOTICE that on Wednesday, July 9, 2025, the Council of The Corporation of the Municipality of Kincardine passed By-law No. 2025-084 under Section 2 of the Development Charges Act, 1997, with respect to area-specific development charges rates for the Gary Street Lands.
AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under Section 14 of the Act in respect to the by-law by filing with the Clerk of The Corporation of the Municipality of Kincardine, not later than Monday, August 18, 2025, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection.
The charges in the aforementioned by-law will apply to all new residential and non-residential development in the Gary Street Lands, subject to certain terms, conditions and limited exemptions as identified therein.
The development charges are levied against new development in the Gary Street Lands to pay for the increased capital costs related to the provision of such area-specific municipal services as storm water infrastructure, sanitary sewer, watermains, roads and related and associated financing costs. The area-specific development charges imposed by the by-law are as follows:
Development Charge per Net Hectare $76,545
Development charges are imposed on the development of all lands located within the geographic boundary of the Gary Street Lands as identified in the key map shown below.

The land area based development charge rates are in effect as of July 9, 2025. Copies of the complete development charges by-law are available for examination in the offices of the Municipality located at 1475 Concession 5, R.R. #5, Kincardine, ON, N2Z 2X6 and on the website at https://www.kincardine.ca/build-invest-and-grow/development-planning-and-zoning/development-charges/.

Applicants should review the approved By-Law No. 2021-114 which imposes municipal-wide development charges for municipal services.
Development charges apply to any residential or non-residential development if you are:
Constructing a new building (not replacement)
Building an addition or alteration to an existing building which increases the floor area or number of units
Changing the use of a property
For development types subject to a Site Plan or Zoning By-Law amendments, the development charges is calculated the day a complete application is received and frozen for a period of up to two years from Site Plan approval (Bill 108.)
If a building permit has not been issued within the two-year period, the development charges rate will be the rate effective the date the building permit is issued.
There are also deferred payment schedules for:
rental housing
certain institutional
non-profit developments
For all other development types, the development charges are calculated and collected on the date a building permit is issued.
