Winter Maintenance - Parking Restrictions

Posted On Thursday November 15, 2018

The  Municipality of Kincardine requests the cooperation of it residents regarding the parking of cars and other vehicles, and the depositing of snow on municipal roads during the period in which snow clearing operations are necessary.

As per By-Law 2009-006 Parking is not permitted on any street within the Municipality of Kincardine between the hours of 3:00 a.m. and 6:00 a.m., from November 30th  to April 1st.

Violators may have their vehicles towed at their own expense.

Outside of the Parking By-law restrictions residents are asked that vehicles are not parked on Municipal roads during snow events, the Municipality may have these vehicles removed at the owners expense under the Highway Traffic Act Section 170 (12) which states: No person shall park or stand a vehicle on a highway in such a manner as to interfere with the movement of traffic or the clearing of snow from the highway.  R.S.O. 1990, c. H.8, s. 170 (12).

Residents of the Municipality of Kincardine are also reminded that, pursuant to Section 181 of the Highway Traffic Act: No person shall deposit snow or ice on a roadway without permission in writing to do so from the Ministry or the Road Authority responsible for the maintenance of the road R.S.O. 1990, c. H.8, s. 181.

Neither the Municipality, nor the Snow Plow Operators will be held financially responsible for any damages to a homeowner's property deemed to be on the Municipal road allowance when performing their daily maintenance operations. This includes, but is not limited to, damages involving fences, mailboxes, entranceways and irrigation systems.

Municipal staff and snow plow operators appreciate your cooperation and will continue to maintain the Municipal road system to the best of their ability. There is no practical way to plow the roads without depositing snow into driveways. Equipment breakdowns and/or delays are inevitable.

The Municipality suggests residents consider snow removal around their private mailboxes to assist in damage prevention related to Municipal maintenance efforts.

Your cooperation in this matter is greatly appreciated.
