Scottish Festival By-law Exemption
To facilitate the 2022 Scottish Festival, the event organizers as part of the Municipality's Special Events process have requested to be designated an event of Municipal Significance, as well requesting exemptions to the Municipality's Alcohol Risk Management Policy.
- Council declared the Kincardine Scottish Festival and Highland Games (KSFHG) as a Municipally Significant Event that will take place, July 1, 2, and 3, 2022 at Victoria Park.
- Council granted an exemption from GG.1.6 Alcohol Risk Management Policy (ARMP) to allow the extension of serving hours of the KSFHG licensed Pub Tent until 2:00 am on Saturday July 2, 2022 and Sunday July 3, 2022 subject to any required municipal approvals;
- Council approved the KSFHG's request for an exemption to the ARMO to allow the sale of tickets until 1:45 a.m. on Saturday July 2, 2022 and Sunday July 3, 2022 subject to any required municipal approvals;
- Council approved the KSFHG's request for an exemption to the ARMP to allow the sale of 4 tickets at a time to each person between 11:00 p.m. and 1:00 a.m. Friday July 1 to Sunday July 3 subject to any required municipal approvals;
- all pets, excluding service animals will be prohibited from Victoria Park from 3:00 p.m. on Friday July 1, 2022 to 6:00 p.m. on Sunday July 3, 2022 to facilitate KSFHG events.
Bruce Township Community Centre Stove
Staff were directed to provide an updated report by July 11th on the stove replacement project at the Bruce Township Community Centre that includes the requirements to have the stove replacement completed.
Municipal Flag Protocol Policy
Council approved the Municipal Flag Protocol Policy as presented.
Municipal Accommodation Tax
Council received the report CAO General-2022-02 Municipal Accommodation Tax- Introductory Report for information. And Council will consider a Municipal Accommodation Tax implementation plan in 2023.

Council approved the Appointment of the By-law Enforcement (James Special Services Inc.) June 2022 By-law.
Restricted Acts Delegation of Powers (2022) By-law
The “Restricted Acts Delegation of Powers (2022) By-law” was approved by Council.
Appoint Authority for Site Plan Approval By-law
Council appointed the Authority for Site Plan Approval By-law.
Municipality of Kincardine Site Plan Control (2022) By-law
The “Municipality of Kincardine Site Plan Control (2022) By-law” was approved by Council.
Public Nuisance Amendment (1) By-law
The Municipality has not yet received approval for the set fines application from the Ministry of the Attorney General, due to a back log of applications. This By-law was to come into effect on July 1, 2022 however, without the approved set fines, we will not be able to utilize the fines. To ensure that we can still utilize the existing fines, Staff would like to amend the effective date of this by-law to September 12, 2022.
Harold Elston, Integrity Commissioner provided an overview of his report and recommendations. Council voted to suspend Councillor Fitzsimmons’s remuneration for 30 days. Councillor Fitzsimmons issued an apology to staff, Council and the community.
Committee of the Whole
Municipal Innovation Institute - Joint IT Business Analysis – Delegation
The Municipal Innovation Council (“MIC”) is a collaborative body (created as a three–year pilot project) comprised of members from 8 different Municipal organizations in Southwestern Ontario, Canada. The MIC’s primary objective is to assist its member Municipalities in collaboratively identifying and implementing opportunities and recommendations across its member Municipalities in order to improve service delivery capabilities, and thereby enhance the resident experience for citizens in each community. In particular, improving IT service delivery emerged as a key opportunity area that the MIC desired to explore further in 2021, which was further assisted through funding provided by the Province of Ontario (Ministry of Municipal Affairs and Housing) through the Municipal Modernization Program.
In January 2022, GHD Digital was engaged to support the MIC in conducting a Joint IT Business Analysis Review (“Project”, “Review”) with its member Municipalities to develop a strategy that:
- Addressed the current and future needs of the MIC member Municipalities’ information technology solutions
- Analyzed the current IT spend
- Identified and prioritized opportunities for cost savings through shared services or Digital modernization
Dave Myette and Mike Hahn - Lake Huron Fishing Club - Overview of History and Operations of LHFC– Delegation
The delegates provided an overview of the services provided by the Lake Huron Fishing Club and requested that by-law enforcement not occur during the morning of the Fishing Derby.
Staff developed preliminary budget numbers for a suggested Dog Park to be considered at Upper Park in Inverhuron. Council directed this to be included in the 2023 budget deliberations.
The new Kincardine Farmers Market agreement is to formalize the arrangement with the Municipality for the land required to host the Farmers Market at Connaught Park. Council passed a by-law to approve the 2022 Kincardine Farmers Market Agreement.
Staff provided a change in operation hours for the summer months at the Davidson Centre facility. Staff have been reviewing the summer hours that historically the Davidson Centre has been open to the public. Typically, this facility is fully open during the months of July and August from 6:00 AM to 11:00 PM daily. Records indicate that there is very little traffic entering the facilities in the later evening hours during weekdays, and on weekends. To manage budget and to focus on areas in high demand during the summer months staff will be implementing a shift in hours of operation. Currently during the summer months, the pool accommodates lane swims on Saturdays from 7:00-8:30AM and general swims from 2:00-4:00 PM on Saturdays and Sundays. I
Previous user numbers indicated that the average participant numbers during these swims averaged around 28 general swims and 13 lane swims. With only one or two swims offered during a weekend, it makes little sense to remain open for this duration. For the months of July and August, the pool will be closed on Saturdays and Sundays of this year.
For the rest of the amenities in the Davidson Centre, closing operating hours will be 9:00 PM on weeknights and 6:00 PM on weekends. This should have minimal impact on the Health Club which experiences an average of 3-4 users after 7:00PM, and even less impact on the walking track and gymnasium. For special events including summer ice and swim meets within the facilities, these events will certainly be available for users to book in advance and enjoy the amenities. What this provides is added resources to assist in outside operations during a time when a tremendous number of pressures are experienced by staff in ensuring our green spaces are to the level of standard our users should be receiving.
Whitney Crawford Community Centre Agreement
Council approved a five-year lease agreement with the Tiverton and District Lions Club to manage and operate the Whitney Crawford Community Centre.
Kincardine Tennis Club Agreement
Council approved a formalized User Agreement between the Municipality and the Kincardine Tennis Club. This will provide clarity on the direction and operations of the facility.
Inclusion, Diversity, Equity and Access (IDEA) Committee Status Update
The Municipality of Kincardine has committed to developing an Inclusion, Diversity, Equity and Access Strategy. An Inclusion, Diversity, Equity and Access (IDEA) Committee was established with the first task to develop an IDEA Strategy based on public input.
The committee has been meeting since August 2021. During meetings the members noted that the composition of the Committee did not reflect the diversity of the community. The committee brainstormed suggestions to remediate this challenge. Council considered the IDEA committee suggestion on March 7, 2022,
All members of the IDEA Committee have resigned effective June 6, 2022. The letters of resignation were attached to this report. Council approved that the recruitment for this Committee take place with the new term of Council.
